Living Trust a Boon to Heirs

Is Living Trust a Boon to Heirs? For someone wanting to ensure the security of his family even after his time of death, setting up a living trust may be one of the wisest moves to make. It is considered as important as preparing your last will and testament.

A living trust is a revocable trust that allows an individual to keep his properties in a private trust that is outside the control of the probate court. Thus, they can avoid the process of probate in the event of incapacity or death.
Most people who set up living trusts do so for this reason because they want to avoid the expense, delay and lack of privacy involved in probate.

In most U.S. cities like Valencia, California, probate fees are within the range of 4-8% of the total value of your assets; and if you have a considerably large amount of property, the equivalent of this percentage may be significantly higher than the expense involved in setting up a living trust. Naturally, one would opt for the least expensive process.

Furthermore, going through probate could take six months or more while the distribution of assets held in a living trust can only take a few weeks. There is no question that time is a very important consideration for any individual. A trust also protects the grantor and benficiaries’ privacy since it is a private transaction and documents relating to properties held in trust are not accessible to the public, unlike those that are held in probate court.

Because of the above benefits as well as other considerations, living trust is now gaining popularity as a good way of preparing for the future. Before embarking on this venture, however, it is best to get advice from a lawyer so as to ensure that your trust is properly managed. There are several attorneys who specialize in this field and can give you the necessary guidance before you make your final decision. For more information contact:

In this sometimes cruel world, we can consider the tax lawyers as our knights in shining armor especially during legal tax proceedings. Do you agree with me? Definitely, I think so. However, I must say that being a tax lawyer in California is really never easy. One must have the expertise and experience in efficiently representing a client regarding a legal tax problem. Also, he must have at least gained a reputable name in the legal tax genre to also gain the trust and respect from those people who need their legal tax advice.

As we all know, a California tax lawyer specializes in a certain field of the tax law and handles a wide range of legal matters that can vary due to several factors. This is what makes the legal tax profession a truly complicated and challenging task. Private individuals and business people depend on their tax lawyers to understand their legal rights and protect their financial interests. Having a good legal advice can help people in complying with and going over the complex network of government tax rules and tax regulations.

LIVING TRUSTS TO AVOID PROBATE?

LIVING TRUSTS IN VALENCIA, CALIFORNIA

1. Probate Is Expensive. In general, attorneys love probates because we are entitled to charge large fees on a probate. However, what is good for attorneys is not what is best for your heirs. In California, statutory probate fees range from 4-8% of the gross value of your estate. Court costs and appraisal fees are added to that. A properly created and maintained California living trust avoids probate. When you are gone, your successor trustee simply pays your last bills, reads your trust to see who gets your property, and then distributes the property. This all occurs without reporting to the probate court.

2. Probate Means Delay. A probate takes a minimum of six months (usually over a year) to get your assets to your heirs. We feel this delay is actually worse than the expense of a probate because of the potential hardship and emotional drain. On the other hand, the bulk of the property in a living trust is generally distributed in a few short weeks.

3. Probate Invades Your Privacy. A probate is open to the public. In a probate, anyone can go to the court clerk’s office and find out a surprising amount of information about the deceased and his or her family. A living trust, on the other hand, avoids such an invasion of privacy. No probate is needed if the living trust is set up and maintained properly. With a living trust, only your heirs and your attorney will know the details of your affairs.
